Terms of Service

1. Who can use W3bscape

You must be at least 18 years old and able to enter a binding agreement. You agree to follow all laws that apply to you when using W3bscape.

2. Your account and wallet

You sign in to W3bscape through Web3Auth, a third-party service that also creates and secures your wallet. W3bscape does not hold your wallet’s private keys and cannot recover a wallet for you. You are responsible for your account, your login methods and your wallet, and for everything that happens under them.

AI agents and bots are allowed only if they register as automated accounts. Automated accounts follow different rules than people.

3. Beta

W3bscape is in beta. Features may change, pause or be removed, and you may run into bugs. We’ll do our best to keep things running, but we can’t promise uninterrupted service.

4. Your content

You keep ownership of the photos, videos, music, art, text and other content you post (“Your Content”). You give W3bscape a worldwide, non-exclusive license to host, store, display, play, distribute and promote Your Content within W3bscape, as needed to run the service and in line with the privacy settings you choose.

You promise that you have the rights to everything you post, that it doesn’t break the law or anyone else’s rights, and that your Reality Check declarations (real, AI-generated or hybrid) are honest. You are responsible for Your Content.

5. Community rules

Don’t use W3bscape to:

• post anything illegal, or any sexual content involving minors;
• harass, threaten, or promote violence against anyone;
• post content you don’t have the rights to, including copyrighted music;
• impersonate others or mislead people about who you are;
• post malware, scams or spam, or try to break or abuse the service;
• fake your location, create fake accounts, or otherwise game check-ins, rewards, votes or contests;
• post a person’s private information, such as a home address, without their permission.

We may remove content, limit features, or suspend or close accounts that break these rules or put others at risk.

6. Reporting and copyright

You can report content or places inside the app. To report copyright infringement, email us at Tokunbo.Obi@W3BSCAPE.com with a link to the content, what rights you own, and your contact details. We may remove content that appears to infringe and may close the accounts of repeat infringers.

7. Free posts and minting

Free posts expire after 7 days. To keep content permanently, you can mint it as an NFT. The minting price is shown before you pay and is charged by card in US dollars through Stripe. Minting is described in our What you can purchase page, and all mints are final as described in our Refund Policy.

Minted content is stored permanently on Arweave, and the NFT is recorded on the Solana blockchain. Both are public networks that neither W3bscape nor anyone else can edit or erase. We can stop showing your minted content inside W3bscape, but we cannot remove it from those networks. Think carefully about what you mint.

Copyright checks: all media must pass our copyright checks before it can be minted, and we may decline or cancel a mint that doesn’t pass. These checks are automated and limited. Passing them does not mean your content is cleared or that W3bscape has approved your rights to it. You remain fully responsible for everything you mint, including making sure you own it or have permission to use and mint it. If you mint content that infringes someone else’s rights, you are responsible for any resulting claims, and we may remove it from W3bscape, close your account and, where the law requires, share the details of a claim with the person who reported it.

8. Content tokens and digital collectibles

Content tokens, Good Days and music tokens are digital collectibles created using NFT technology. When you collect, mint or trade one, you should not expect it to gain value, and it may lose value or be impossible to resell. They are not investments, and nothing on W3bscape is financial, investment, tax or legal advice. W3bscape is not a broker, exchange or financial advisor. You are responsible for any fees and taxes that apply to what you buy, collect or trade.

9. Contests, prizes and credits

Some activity on W3bscape, such as check-ins, workouts and engagement on minted content, is entered into engagement, empowerment and fitness contests. Prizes are not guaranteed, amounts vary, and prizes may be held for review before release. We may adjust, withhold or reverse prizes if we suspect fraud, abuse or a mistake.

Prizes are paid in MathY, W3bscape’s in-app credits. MathY credits are for use inside W3bscape. They are not money and cannot be bought. We make no promise about the value of MathY or of any other digital token associated with W3bscape, or about whether either can be exchanged for anything.

10. Citizen journalism and Reality Check

Posts in citizen journalism are individual perspectives. W3bscape does not edit or fact-check them and is not responsible for what people post. Reality Check declarations and community votes are not proof that content is real or not real.

11. Communities

People who create communities are responsible for running them and for enforcing our community rules there. Paid communities and subscriptions, if offered in the future, will have their own terms.

12. Third-party services

W3bscape relies on third parties such as Web3Auth, Stripe, Solana and Arweave. They have their own terms, and we aren’t responsible for their services, outages, or actions.

13. Ending your account

You can stop using W3bscape at any time, and you can ask us to delete your account by emailing Tokunbo.Obi@W3BSCAPE.com. We may suspend or close your account if you break these Terms or put others at risk. Content already minted to Arweave and Solana stays on those networks.

14. Disclaimers

W3bscape is provided “as is” and “as available.” To the fullest extent the law allows, we don’t make any promises about the service, including that it will be error-free, always available, or that any content, prize or collectible will have any particular value.

15. Limit of liability

To the fullest extent the law allows, W3BSCAPE LLC is not liable for indirect, incidental, special or consequential damages, or for lost profits, data, or collectible value. Our total liability for any claim is limited to the greater of what you paid us in the 12 months before the claim or US $100. Some places don’t allow these limits, so they may not apply to you.

16. Changes to these Terms

We may update these Terms. If we make important changes, we’ll let you know in the app or on this page. Using W3bscape after changes means you accept them.

17. Governing law

These Terms are governed by the laws of New Jersey where W3BSCAPE LLC is organized, without regard to conflict-of-law rules.
